34. A summary of the proposals as amended that were received in the Call for bids (the
“Confidential Bid Summary”) will be provided to the Court as “Confidential Appendix C”
(Under Seal) The Monitor requests that the Confidential Bid Summary be filed under seal.
35. The purchase consideration proposed by the Leading Bidders is being kept confidential at this
time. The purchase consideration is commercially sensitive information. If the transaction
described below was not completed as anticipated and the assets and businesses of the Company
needed to be the subject of a further marketing process, the disclosure of the proposed purchase
consideration would be prejudicial to any such future marketing efforts.
