While yes the time will be elongated, the degree to which the defendants actual defense was just undermined, cannot be ignored. Equally, the degree to which the potential damages just dramatically increased along with enhanced motivation for a possible pre trial settlement too has dramatically increased. In simplest terms, the risk profile of the case has now shifted. Risk vs reward is always a factor in counsel choosing to resolve these matters prior to trial.
