I don't think that I have to. You're making me guess which part of the sentence that you highlighted you would like me to reconsider. Use your words.
In your subsequent post you say "IPIX only needed to meet 1 of the 6 transaction requirements to register"
My questions have nothing to do with whether IPIX could file the S-3 and register the shares but rather whether there are potential limitations on the sale of those shares (aka a transaction). Note that the quoted Instruction covers Transaction Requirements.
There is a separate section for Registrant Requirements which the Company obviously met before filing the S-3.
A gander isn't enough to fathom the full S-3 Instructions (or my post).
If the phrase that you would like me to consider is "as of a date within 60 days prior to the date of filing" I think you might want to take a peek at the Historical Prices page and extend the highest price you can find by the last reported number of non-affiliated shareholders as I did before I posted.
I've said it before....I could be wrong about this but I don't think it was wrong to raise the question. The issue of whether the full Aspire line is available and if it isn't whether management is being impeded from taking actions it otherwise might take should be interesting to anyone with an interest in the Company. If I AM wrong we'll all learn something from you or someone else showing me how...at least I will.
From your responses so far it seems as if you would expect the Company to answer each of these questions with a clear "No". Is that correct?:
Is the fact that the market value of the holdings of IPIX's non-affiliated shareholders is less than $75M, which has the potential to limit access to the full value of the S-3 registration and the entire balance of the Aspire line, having any bearing on management's operating decisions or isn't it? Are any trials being delayed for financial reasons attributable to the limitations described in the S-3 Registration Statement's Instruction 1.B.6 (not counting P3 B ABSSSI, of course)?
Do you have something to offer in terms of the operational questions asked previously: "What trials are on IPIX's current agenda....as in What's next?"
I know that there are 3 primary drugs with at least 7-8 trials already completed for various indications, dosages and methods of delivery. To put it simply, what do you expect the next clinical trial to involve and can you link me to the Company's answer to that question if there has been one? I'm sure I just missed it. Please keep it simple.
