Judge ruled sufficient evidence in favor of MYDX when The Judge OVERRULED the demurmer in favor of MYDX. How would the case be thrown out?

The defendants only way to avoid trial is to settle.

Settlement already? I expected at least 6 months before that actually happened. If they were going to throw it out the demurrer wouldn’t have been overruled by the judge. That was the only time for this to be thrown out. It’s either continue to the civil jury trial or settlement. Those are the only options for the defendants.
