The FCC has control of the 692 spectrum licenses, so they certainly can dictate terms for any agreement between themselves & AT&T, & if the parties don't agree, the FCC will say see you in court, and even if the reorganized Fibertower wins in Texas, the FCC can keep fighting and delaying the licenses transfer for 3 to 5 years after that.

As for Fibertower filing bankruptcy to begin with, that was going to happen, regardless if a spectrum buildout extension was granted, the boys were getting out of the backhaul business, and into just the warehouse of the spectrum business, for their gain, for their gain, and lastly, their gain.
