No doubt, possibly a disbarred attorney though :) but most likely it was TJ or Valerie. I think it's intentionally vague as protection from the SEC, the Colorado sos filings are just as vague, and the S-1 from June was ridiculous, as Surfkast would say it's right out of the "Joseph Wade Mezey playbook." The "as a whole" thing really bothered me too, it was just so stupid. Also it's pretty weird for a company not to have a signature line at the bottom of their email with company name, address and phone, or at least signed by whoever wrote it. But like you said an idiot drafted it.
