Technically (if I have this straight), cognate is the defendant while Yonemura on behalf of NWBO is the plaintiff. So I am not clear on how both the the plaintiff and defendant can be represented by the same lawyer? May there be waivers involved in order for them to share the same lawyer? Seems weird to me. Do you (I) have that right?


Do to artifacts of common law, when Y sues in this case, she must name NWBO as a "nominal defendant". This in some way puts them on both sides of the aisle.
