We do have to be careful that populism doesn't result in throwing out the good with the bad, and that's always a risk with populist movements, including revolutions, ala Venezuela right now, if we want to look elsewhere for examples.
And the nature of the law, is that there will always be some subjectivity, from the plaintiff's, their lawyers, to the judges and the juries. That's the nature of human society and human relations. The very passions that you think could reform, through revolution, also inflame passions of juries, and cause judges to make politicized decisions, especially if they are elected. These are complex and interrelated issues, but I think we agree mostly. :)
