That isn't how the court system works... this is coming to a head one way or another!

This deadline is firm. Because CCGI's CEO may not be able to present the court's recommendation to his board prior to the response deadline, he may respond on his behalf and state whether he is willing to recommend that the board accept the court's settlement recommendation.

I highly doubt the BOD would refuse to pay if the CEO recommends the settlement to them. That would definitely piss of the court...

If CCGI does not settle now, this goes back to Judge Bucklo and she has no love for CCGI! CCGI either loses a chunk here or a much bigger chunk later!

While I have no love for CCGI, they have many assets and many large financial backers already in deep... and they have never had trouble raising money even with all their debt! This is a sector with huge future dollars to be reaped, and many companies and large investors are betting on it!
