This was addressed several times, but the answer is one that appears unwelcomed.
The company does not have to deal with any ill filed USPTO application of a trademark that is in violation of a similar "Previous Art" ruling (confusion within a marketplace). The subject was dead before it even started.
That trademark will be invalidated with or without intervention. That is the law. People are welcome to petition the USPTO to change its protocols.
