I guess. But, a 10 year long association with a guy that has been sanctioned for serious securities fraud is not a smart way to go if one is promoting their own public company. I doubt he can claim ignorance.
And the environmental permitting thing is pretty damning too - for a company that specializes in such things, they seem to be ignoring the facts in favor of issuing a snazzy PR.
