An Emergency Medicine physician has a very broad understanding of medicine. It is extremely unlikely that such a physician would write an article with so many basic science errors. Gram positive/gram negative is pretty basic stuff for an ER doc.
Incorporation is not necessary to receive a 1099 and the payment from SA is unlikely large enough to justify fees related to incorporating. As far as legal protection, the corporate veil can be pierced if actions are wrongful and/or fraudulent.
