If AMPH’s allegation is that NVS/MNTA’s obtaining a preliminary injunction in Oct 2011 constitutes an antitrust violation, then this new lawsuit may be a signal that AMPH expects to lose the Lovenox patent case.
I would tend to agree with you. They had previously filed an antitrust 'whistleblower' suit which was thrown out of court and they were scolded for it.
The reason they lost the whistleblower suit was that they couldn't prove damage.
I would think that they could also prove damages if the patents were deemed unpatentable.
I think you're on to something. It is my guess that ampha is starting to grasp at straws. You can't grok the mind of these owners but I claim that I do. They are starting to suck wind. heheh. I have bought 6K of mnta at 16 and change so far. I will look to add more if the general mkt throws up some more and weak hands ditch mnta. One can never be sure in the stock mkt but this is starting to smell like something I would want to pile in on.
