Because Apple knew many months earlier that it just wasn't going to happen but encouraged their little league friend to hang in there as if it was still possible. I don't think it was all evil intentions, but Apple giggled watching GT sweating but saw the filing of BC as a total adversarial stance. If Gt had not filed BC how would the story be-Apple would have gobbled GT up
