If all Amrn is fighting for in regards to NCE is 2 more yrs what is the point? Is the fight for NCE to open the doors for proving a greater injustice to Amrn? Will they pursue getting SPA back on the table? Anchor? Would appreciate your thoughts.
We agree to disagree...under the circumstances Judge can start exclusivity and not apply it retroactive. Retroactive application is not the intent of Congress and Amarin never benefitted from the exclusivity.
If Amarin wins, they will be awarded 5 yrs NCE from date of judgement.
As the Judge says, "what does the law say?". Congressional intent was not for retroactive application of exclusivity. Amarin was clearly damaged and will not recoup the losses by not being assigned after approval as per regulatory scheme.
