it says they are holding > 10% and that all shares will be voted together...it says:
Fidelity Management & Research Company carries out the voting of the shares under written guidelines established by the Fidelity Funds' Boards of Trustees.
I had seen this reported by a third party. If I understand it correctly they were prohibited from buying or selling stock after the 7th, so either they bought big on the 6th - possible - or they were buying at higher prices.
Please note - FMR is family controlled by the Johnson family - and it appears to be playing straight, not hedge fund. Undoubtably the Judge knew of their ownership percentage and this is why he gave them the right to buy GTAT paper, their interest lies squarely with that of the company and stockholders.
