Bill you missed my point about the countersuit...

I have posted earlier that A@P was boasting of being the force behind the suit and probably acted as he did with the Cooks, by setting them up to do his dirty work, except this time, it's Ann Scheuer... In addition, you have the obvious stock manipulations by NAIB and Co and now, evidence of short covering... You also know that NASD and SEC have been watching intently all along...

If the suit doesn't succeed through insufficient number of shares represented by the Lead Plaintiffs or for any other reasons, then the shareholders - NOT SEVU - would have every right to seek compensation for the loss of value of their shares, as a result of the PR announcing the failed suit, hence the potential countersuit against the Lead plaintiffs...

Even if the suit is recognized as a Class action suit by the Judge and succeeds, where will the compensation money come from?... SEVU hasn't got a dime and I doubt that there is any insurance carried out by the Directors and/or McBride... If McBride has personal wealth and can be persuaded to part with it, it's very unlikely to provide much compensation to the shareholders, after the Lawyers have paid themselves... I know that the Lawyers told you they've done their DD, but that's NOT good enough for me, as it appears to be a Shorters sponsored Lawsuit...

You have till July 16th to come forward as Lead plaintiff and I suggest you control your impulsive nature and wait to see what happens before jumping on the bandwagon...

Bill, Lead Plaintiff mightn't be a good idea...

after all, as it could considerably weaken the case and you should make the Attorneys aware of your past posting activities... Here is why:

1) You virtually admitted violation of Insider Trading Laws when you posted:

Hi Brettin, weird timing...

Going into today (Wednesday), I actually had no position in SEVU. Today I went long for 24,400 shares, and will probably add about the same amount tomorrow.

It seems to me that all the bad news is finally out. I expect to see a PR on May 7 confirming production. Also, Rich has publicly stated that he was actively buying shares last month, and that must be disclosed, as you know, in SEC filings by May 10. And Yes, I do believe his statement that he was buying shares. Even Rich is not stupid enough, as THE major shareholder, to publicly declare he was buying shares if he wasn’t.


3) You say you sold because the Form 4 filing didn't happen shortly after May 10th... These Forms are mainly mailed and take weeks before they're process and appear on Freeedgar... I'd be very surprised if the filing doesn't appear in the near future...

Failing to receive a favorable response, I sold all of my holdings in SEVU the next morning. I wanted out, at any price. That was my selling that drove the price from .58 to .42 in thirty minutes. I unloaded the rest throughout the day.

There will be no lawsuits....

Those types of suits are handeled on a contigency basis, and no lawyer will sue on that basis if there is not a reasonable expection of recoverable assets. No money, no suit. There are many other potential targets that do offer a potential for recovery.

In my view, anyone having a posting record on SEVU is likely to weaken the lawsuit, some more than others...

Go for it BillBranum, at least you can keep us updated on when the crap hits the fan. Please go after Rich, it would be an interesting suit and countersuit.

I believe it was stated here before that the SEC filing is often NOT filed in this case, so don't get in a tissy about this. Rich did buy shares, but I don't know where/if the SEC filing is. It is also my understanding that the SEC only has a simple, small penalty to pay for not filing by the 10th of the month. IMO, who cares about a small penalty when it can make people like you mad!!!!!!
