They most likely close to that already these guys don't work cheap.

Bottomline Pfizer being so huge someone dropped the ball regarding Ponezumab PF-04360365 the ongoing trial which was first received March 2013 but was still being worked on in house at Pfizer long before that trial started.

That being said the defense should have done there on due diligence once being handed the case so not only did Pfizer screw up so did there defense team in house and out of house.

No way can they allow this to go to trial and its already been made clear by judge Oing its going to be resolved in summary judgement as things get flushed out on the court transcript not my words but judge Oing's words.

Its undisputed factual they have continued the use of Ponezumab.Its undisputed the agreement was not terminated also factual.Its undisputed factual Ponezumab is apart of the license agreement and schedule.

Oing also makes that clear imho regarding later on its becomes factual (so maybe it is) covered.

They can only delay in the end they pay big time.
