I think you're right technically, but, as you suggest, I am unaware of any examples of the SEC enforcing this for a non-reporting company.
Maybe we should start a little campaign to persuade them to do that. After all, the onus is on the individual, not the company. And those forms aren't exactly a big deal to fill out and file.
