the thought that went into this masters order is encouraging. bobby p. is being minimized with every new ruling out of another court.

Special master order in MU vs Rambus. Found a passage pertaining to Virginia law that I found quite interesting.

Unable to copy and paste so bear with me please.

Second of last paragraph on page 30.

under viginia law, silence does not constitute concealment in the absence of a duty to disclose.

Then the special master goes on to discuss why Rambus did not have a duty to disclose the patent applications to JEDEC. We all the know the story behind this (See CAFC and FTC ALJ decisions where Rambus was not required to disclose). The specail master does a wonderful job of dissecting the JEDEC rules. Worth the effort to read the discussion starting on page 30.

Looks like MUs defense is crumbling around them already. No wonder they high tailed it to Virginia.

How the hell did Payne get this so wrong?
