Nice post. Too bad it's complete and utter hogwash. I'll give you this: If your theory was true and Zig actually led the company into this mess, yet another reason to ask for his immediate resignation.

I look forward to seeing the lawsuit. I am sure it will be produced right after those high priced attorneys get those patents submitted...or is it the franchise program they're working on? Oh, and I've got some contacts at GT as well - the high profile law firm that has distanced themselves from Zig...Hey where's that $5 mil deposit at?

You seem to know the local market, and before I respond to your points, at least agree to this: Anyone with half a business brain would have done the research to determine the details of the state of the business and client base through proper due diligence. I mean, it was all over the news!

RESPONSES:

My friend was a member and Zig and his group were in good favor with all of the members there and all the women were sad to see them goo. RESPONSE: Yeah, someone came in and offered to make good on their remaining memberships and offered a place to workout for free. Was your "friend" a new member? Did they pay Zig anything? Are they getting their money back?

We have have been asked to join Motion DNA in a lawsuit against the landlord...who is not CBRE, but Bruce Campbell and Arrowhead Executive Center LLC..this guy lied and produced fraudulent documents becasue he was losing his tail on this building and needed someone in with deep pockets. RESPONSE: Isn't Campbell just an agent with CBRE? I don't understand the "we" in your note - Freudian slip? Businesses go bad all the time and replacement tenants are found all of the time. Losing his tail? I think not. That building's value probably appreciated 70% this past year. As stated previously, I am not a fan of most building owners but Zig is the one with the track record that points toward who is the scamster.

Motion DNA was the ticket...there were other suitors for the location, but he wanted Motion DNA. RESPONSE: Hogwash. They've been trying to find someone, anyone to take over this center and the landlord hasn't been running the business or maintaining the client base. A major gym just opened around the corner and this space will be a dog, unless you define a special niche and find new clients. However, Zig was looking for another diversion and he found it. How's the TV show doing? The only thing that made sense was going after the existing clientele with the promise of honoring their memberships and keeping some. Problem was, these Curves level chicks could care less about his unpatentable, old useless front end application supposedly for NFL level players. Hey, just checked NFL Network - Where's Motion DNA? I did like his idea of targeting young female athletes, but again, the product just isn't there.

I did hear that CBRE would be named in the suit later but they share the same law firm as Motion DNA. the landlord has a different attorney. Suit is seeking over $100 million in actual and punitive damages for the company and over 1000 members who were impacted by the brokers and the landlords fraud. RESPONSE: Wow, that sets the record for health club memberships! $100,000 a member? Dang, I've got to buy me a Gold's Gym! Got news for you - If there were 1,000 paying members paying even $39/month base, this gym wouldn't have folded to begin with!

they sold the memberships weeks before they sold them to Motion DNA again. RESPONSE: Now, them's fighting words if true...and likely a professional slander claim against Zig if BS. Let me get this straight: the landlord and his agent sold the client list twice? They would sell a list of gray hairs and Curves clan members to a third party and basically throw away any chance of finding a replacement tenant? Again, please use logic - it is the best tool to slice through BS. You've seen The Producers too many times.

I'm a shareholder too so I know what the history is here...but this was a legitimate shot at making something stick. keep it up Skeena..you're not alone RESPONSE: On supporting Skeena - Sorry, you left yourself wide open to this one - Yup, just as God intended - boobs should come in pairs. smile Just my opinion but placing Zig and "legitimate" in the same sentence is an oxymoron.
