Can't call this a scam myself. Just a small Company that failed privately, and went public.
I think if they register with the SEC, and start reporting, using all that money they have in the bank, "the millions" to pay for that, the Market would respond in a positive manner.
Line up traditional financing to go along with that would also be another check in the right block.
If they continue the same old OTC scams of convertible discounted share selling notes, well, it would be what it is, and treat accordingly.
