bulldzr: Here is what 10-K, annual report filings had to say about IDCC - Alcatel. Whether any rights they had under the original agreement survived the apparent termination, I have no idea.
"Alcatel. On March 12, 1998, InterDigital entered into an Agreement with
Alcatel covering B-CDMA technology development, CDMA patent licensing, trademark licensing, product development, technology transfer, standards support and other areas of cooperation. Under the terms of the Agreement, Alcatel will be licensed under InterDigital's B-CDMA patents and know-how as well as certain InterDigital trademarks.
Alcatel will purchase its requirements of B-CDMA ASICs from either InterDigital
or InterDigital's designated vendor for embedding into certain wireless
platforms developed and marketed by Alcatel. In addition, Alcatel agreed to pay
a technology transfer and services fee valued at approximately $25 million. Of
this fee, $5.4 million was paid in March 1998. An additional $12.6 million is
expected to be paid in the 1998-1999 time frame, based on the achievement of
certain product development and commercialization milestones. The remaining fee is expected to be paid in conjunction with purchases of B-CDMA ASICs through December 31, 2003. As part of the transaction, Alcatel was also granted an option to purchase $22 million in InterDigital common stock on terms and
conditions to be negotiated. The exercise of this option may be dependent on the
receipt of certain InterDigital corporate approvals.
The Agreement provides that InterDigital and Alcatel will work together to develop enhanced wireless packet data handling capabilities for B-CDMA
technology and establishes a framework for joint development of third generation
applications based on B-CDMA technology. The Agreement also states that Alcatel, with the support of InterDigital and InterDigital's other alliance partners,
will take an active role in promoting the adoption by the leading worldwide
standards bodies for wireless local loop standards and the incorporation of
principal elements of B-CDMA technology in to third and fourth generation mobile applications standards."
"In 1999, both Siemens and Alcatel made corporate decisions not to
invest further in the development of proprietary B-CDMA technology for fixed
wireless applications and to focus their energies on the 3G market. Samsung has
effectively made a similar decision. We, in turn, elected to discontinue our
B-CDMA development efforts. In 1999, we signed a technology transfer and
licensing agreement with Nokia covering high data rate W-CDMA technology."
In regard to an Alcatel -IPWireless agreement. (Alcatel and IPWireless Partner on Mobile Broadband Solution. 2/10/2003 Alcatel and IPWireless Inc. have formed a strategic partnership to add broadband wireless services to mobile operators' GSM/GPRS and W-CDMA offerings.)
Regarding kingofengland's statement that Alcatel had partnered with IP Wireless... Wasn't Alcatel originally one of the members of the B-CDMA alliance with InterDigital, Samsung, and Siemens? I seem to remember that they were involved originally and then dropped out.
If so, does anybody know if they have any carryover ip rights and may be bringing them to the IP Wireless partnership, assuming there is such a partnership?
