The label was approved. You're argument is bogus.

In a court of law, the judge is gonna say an exclusive contract to distribute BBV means a contract that is expected to last at least until the product is distributed.

BRND 'contract' was canceled before even 1 bottle could be distributed.

As soon as the ATF approved the label, BBV could be distributed by licensed distributors. BRND isn't one. Why aren't they?

Looks like BRND failed to deliver.
