I see your point, but in as far as insider trading is concerned, could it be argued that someone gleamed an unfair advantage from simply knowing that the request (which we knew was coming at some point in the near-future), or more to the point, "directive" to do so had been issued?

I for one wouldn't rush to buy shares, simply because I knew the A/S had been increased. First, I would seek to learn by how much it had increased and, more importantly, wait to see if indeed the merger is ratified some time thereafter.
