I see it a bit differently. It was already made public knowledge that there would be a raise to the A/S, in order to facilitate this merger. What was not disclosed, and still hasn't been as of yet, is how much the increase would be. Therefore, at this juncture, it can be argued that no one has an unfair advantage, being made privy to info. before the general public ~ IMO.
