Yes, and today Momenta and Sandoz asked the Judge Gorton to enter his ruling on the sanctions prior to entering final judgment for the summary judgment order. Also pending, as you note, is what damages MNTA might owe -- it would be purely random if that amount were equal to the amount of the bond.
PLAINTIFFS’ MOTION TO REQUEST FINAL RULINGS ON PLAINTIFFS’
MOTION FOR SANCTIONS PRIOR TO ENTRY OF JUDGMENT
On Friday, July 19, 2013, this Court issued its Memorandum of Order allowing Defendants’ Motion for Summary Judgment (“Summary Judgment Order”) (D.I. 497), which was argued before the Court on July 1, 2013. Still pending before this Court and awaiting ruling
is Plaintiffs’ Motion For Sanctions Against Defendants For Their Willful Violations Of Court
Orders (refiled at D.I. 392) (the “Sanctions Motion”), which was also argued on July 1, 2013, before Magistrate Judge Collings.
To ensure that all issues are resolved prior to entry of judgment, Plaintiffs request that this Court enter final rulings on its Sanctions Motion prior to entry of judgment on the Summary Judgment Order.
