Gee a real opportunity here...
Somebody could buy a bunch of opterons, then sort them by Tcase max. they could then easily sell the ones with the lower tcasemax/TDP for more money than they bought them for. Why would AMD be leaving this money on the table?
What is the difference between the standard opteron with a low Tcasemax number and the more expensive opteron HE's?
There is just a whole bunch of issues with your theory here.
