One problem,... people who in prisons and jails for nonviolent crimes should not be there in the first place.
I mean if you attempting to be, or return to our theoretically correct roots and not just exploit the unfortunate for their labor. The Common law, which is the "law of the land" in the Republic is one of the harshest systems of justice there is, but it ALSO requires an injured party of a "concrete and particularized nature", a charging instrument, a chance to face your accuser. two witnesses preferred, and the burden of proof lies on the prosecution, and no presumptions of any kind may be made. Many crimes were capital and the rest required restitution. Our prison population is inordinately high. Those men and women don't belong there, period. This absurd era of limited liability in law rang in about the same time as the Federal Reserve and corporate governance. Something to ponder in that.

This is a side trip to your post I understand, but an important one to consider in general, I think.
