If Montecito had such a great case and WGAS believed that to be true why fight it out. Wouldn't Volk and lawyers say damn we are shit outta luck here lets cave in and give up and get our money and shares back. Why waste so much time and money on this if we didn't stand a chance of getting a judgment in our favour or any chance of a settlement. It just doesn't make any sense at all to continue if we were gonna lose.
