No, it's not. I have no hesitation in calling Jean François Amyot and Andrew Barakett racketeers engaged in several criminal conspiracies to defraud the investing public.

If they disagree, then they have redress available to them.

If we go by criminal convictions in US courts as the sole criterion for labeling someone a criminal, then Al Capone was guilty only of a bad case of tax evasion, was never a gangster or a murderer, and many of today's mafia bosses are not criminals at all.
