On the part of which party? This one is a tough case. IDCC did not have coverage for its patents. Ericy dismissed its defamation claims and from what we can tell no settlement was received for the dismissal. IDCC dismissed its infringement claims and received a lump sum and a licensed royalty stream for a period ending 12/31/2006. It is this source of funds that reimbursement is being claimed and perhaps Nok. It may also be that IDCC refused to disclose the amount of royalty expected to be derived under the E/SNE licenses due to their stated position. Since IDCC made public the expectations for Nok and Samsung, Federal may have made their demand based on these figures being indicative of what E/SNE would pay over the same period of time. Tea leaves are piling up in the driveway once again and nobody but IDCC knows for sure the reasoning behind the Federal demand for the full freight.
