I really don't care how he explains the efficiency. Bottom line is will it cost the consumer less to operate?

All the lab has to do is heat water a predetermined temp rise with a predetermined flow rate and measure the overall power consumption after a predetermined amount of water has been heated. Pick some reasonable numbers like 40° temp rise @ 3gpm. Heat water on/off till 500 gallons have been heated.
Do the same thing for 2 or 3 of the best units currently on the market and see who used the least amount of energy to accomplish it.

To get an overall accurate cost of operation, you will need to add unit and installation cost spread out over lifetime of the expected units.
