I scanned the MTA and used a word search. Honestly, and I may be wrong, but I could not find the word "commercialize" anywhere in the document. Many/most legal contracts provide a definition of terms as to what various terms may mean that could be subject to differing interpretations, but I don't even see "commercialize" used in the MTA. However, "commercialize" is used in the 12/31/10 10-K issued 3/15/11, but it's not defined there either. Maybe I'm missing something, but if it's in writing you can make a decent interpretation (hopefully), but if you ask mgmt what it means, I'm guessing you'll get the NDA response.
