So has anyone called Nick Cerchio of the DTC at (212) 855- 5006, for their official position on clearing the shares? Per their 8/16 notice they are;
"urging(not ordering) DTC participants to take precautions to protect themselves and their customers in light of this continuing problem and to notify correspondent firms and other parties that may be affected(not "Are affected") by this problem."
I don't see an official determination from them that the shares are invalid, they just reference company PRs, and if the SEC isn't jumping on all this just yet, perhaps they will let it trade. The notice said they were suspending all services except "custody services" effective 8/11/05. I think there were plenty of trades that people did that have settled in their accounts since that date.
Wonder if DTC will put out any more bulletins.
