Anyway, You are right it will be interesting to see how Judge Peck rules. I am with you cotton....if we can get paid in full I am willing to walk (no run) away with the cash and let preferreds work the NOLs. Your scenario should be ESPECIALLY EXCITING to all of those that hold both cap trusts and preferreds because yes, the reorganized company can use preferred shares to maximize NOLs (as they are old/cold equity).
