IMO, the best chance we had for recourse against the DTC was when Swinford buckeled to them following his court case against the DTC.
I've written about the court hearing I testified in in Conroe District Court. I was told by Swinford's attorney and Bert Puhlman that the jugde was impressed by the testimony of BBB and me.
The single most damaging piece of testimony was by one of Swinford's attorneys when he described the lenghts his firm went to , to have the Judge's TRO hand delivered to the DTC Houston office on the day it was issued. The DTC ignored te TRO and let stand their orrder to the brokerages to unilaterally force us to buy CTBG shars at inflated prices.
Swinford settled a strong case, out of court. I was told that the DTC told Swinford to settle or they would break him by appealing an adverse ruling.
An attorney for 5 individuals told me that a Houston attorney had a stack of claims against the DTC and was hoping for a ruling against the DTC to strenghten a class action case. The DTC COULD NOT take a chance on being ruled against. IMO.
I will never even consider going against the DTC machine by hiring "hands out" lawyers.
