MNTA needs only one blocking patent to prevent a generic Lovenox from launching
True in the US. Made me think about your theory that Teva's Lovenox origin is Italy. Perhaps somewhere else outside the US. Now, suppose Teva finally gets approved. So I've searched for the '866 equivalent EU patent. I think it's this one:
You can see the claims in the PDF dated 13th May 2009. From some reason Momenta withdrawn this patent. Don't have much time to dig deeper but could be that they have a different patent in EU but also possible they don't and if someone like Teva does all steps outside the US, then they can launch their generics in the US. Perhaps the EU patent attorney on board can look into this.
