I'm no legal mind, but I don't understand why MNTA would wait until *after* discovery to assert other patents?

Momenta has a large library of lovenox related patents and they asserted only a few claims from 2 of the patents - presumably most of the rest are likely to apply only to some of the manufacturing methodologies. And if they asserted all of them now, even if they weren't sure they were being infringed, then they substantially dilute their claims.

PS I too have no background in legal procedure - can it just be added? Does it interfere with previous rulings, ...?
