Data seems convinced no auction is in place

I admit to being somewhat puzzeled....Bloomberg and Data are not seemingy on the same page.I respect Data's knowledge and contribution to this forum so I take his thoughts quite seriously. The fact that the Hart-Scott-Rodino Act requres premerger notification (and to my knowlegde no such filings from any party have occurred to date) leaves me wondering as to where we actally stand at the moment.
Perhaps you and others can shed some additional light on this
