I just don't see it myself. I think the lawsuit is secondary to what the FDA has said to them. Sure they would like to screw MNTA if they could, but not at the cost of their own credibility.
We know the FDA can be fickle and unpredictable and so it is quite believable for me that they ran into some last-minute FDA objection of unknown seriousness. That objection could be anything from terminal (back to the drawing board) to some relatively minor raw material quality control issue that is clearly fixable - we have no way of knowing.
If the objection is terminal I doubt they would announce that fact - they will just leave MNTA in limbo, albeit piling up the dollars. If I'm right, the best case scenario for MNTA is no news, which should result in a steady (albeit unspectacular) increase in stock price over time.
