I just got around to reading the Kosturos deposition this evening. There is an especially interesting section on the contributions of Paulson and Company and their pushing a term sheet around that was a backdoor deal to pay the bank bond holders through the FDIC of course this would have defeated the corporate veil and been completely against the judges ruling.

If I had to guess this is what they were arguing about.
