Raw is technically wrong in that statement, but as a practical matter, he is correct.

The Air permit was in fact approved by DEC region 9 and the draft of that permit was given to JBI for comment prior to official approval. Just after the draft permit was given to JBI the folks in Albany decided that a solid waste permit was required. At that point the Air permit was put on hold pending the approval of the solid waste permit.

DEC regulations require that all required permits be issued at the same time.

So the air permit was approved, then placed on hold prior to being issued, pending the solid waste permit.

Both of you are correct. There is not an issued air permit at this time. The air permit was approved. Issuance was postponed.
