I think the CMKX claim was that they were missing documents. It is only on the cult boards that they claim that CMKX can't file because of NSS issues even though the existance or non-existance of a NS would have nothing to do with filing a 10Q or 10k. The company only has to state the number of shares that they have issued and the number of restiricted shares they have out. They are never required to speculate on short positions. This NSS thing is a red herring that has nothing to do with filing one way or the other.
