John, I think the point being made is that a CAFC ruling for Interdigital may not screw up Elop's day at all. The plan to correct the situation with Interdigital may already be in place.

Elop seems to be saying all the right things at this time. I do believe he sees the situation for Nokia clearly including all of these old issues (like Interdigital) that are still lingering and capable of taking their eyes off the ball once again. I don't think he intends to lose sight of the prize which means he must clean up all past messes to secure Nokia's future.
