dianebRN, the donor contract involves four parties: Mother, Hospital, CBAI and payee OSIRIS. The contract is however negotiated between three CBAI.OB/OSIRIS and mother. CBAI at the negotiation table with mother represents OSIRIS and CBAI.
The contract directs/instructs hospital to forward the property to CBAI.OB based on mother's authorized writ of "Consent" to relinguish said "Ownership" to whom? CBAI/OSIRIS.
The Hosptal doesn't own it after delivery; OSIRIS/CBAI does.
After delivered its new owner instructs/directs the hospital to perform a task per writ of signed consent. Collect three vials of blood and forward those along with the placenta to CBAI. Osiris pays hospital. The document is a legal contract. Again, forward said goods immediatedly after delivery to CBAI lab.
The delivering mother is on notice per writ and signed document that her blood after delivery would be collected and tested by CBAI for specific diseases as outlined. If any diseases are detected by CBAI.OB then she gave all parties involved a release to communicate those findings back to her via; confidentiality agreement.
Again, the donor document is between mother and OSIRIS/CBAI.OB before delivery. Hospital is paid to perform a service after delivery.
All other hospital deliveries w/o a donor aggrement are handled maybe as you report - 30 day hold before destuction. Absent a donor contract the hospital is incapable of selling or donating the placenta or any organ for that matter.
Allosource non-profit a few years ago settled in a lawsuit for harvesting organs of a diseased without first obtaining consent. The family was called after the harvest began and that led to them being held liable.
