The order should be out very soon.

Keep in mind that the standard to get an MSJ granted is high. Thus, failure to get the MSJ granted does not suggest ultimate failure. There may be another MSJ coming on inequitable conduct or other violations of the patent laws. Then there will be a trial if earlier motions do not resolve the case.
