I think the FTC realized they had no case. This is the best they could get.

It's just to save face.

Maybe once Intel is forced (as is required in the settlement) to disclose every case in its compiler and libraries where optimizations are not applied to non-Intel processors, they'll suddenly find a reason to switch.
