I don't think it's Judge's call.Not a professional but I think the attorney-client privileged is well protected and Judge can't just simply scratch it.
Debtor FDIC/JPM has a lot to hide , especially ,the doc that discussed the strategy .I believe examiner can find a way to get the info but expecting some speedbump ahead.
