07/09/2010 ORDER granting 73 Motion for Extension of Time to File -- Notwithstanding the SEC's opposition and its arguable untimeliness, defendant Joel Pensley's request for an extension of time to respond to plaintiff's motion for a preliminary injunction is GRANTED. Defendant Pensley's opposition is now due July 15, 2010 and plaintiff's reply is due on or before July 29, 2010. The court has reviewed plaintiff's opposition to the motion filed today [Docket Entry # 77]. The court admonishes defense counsel that the court takes a dim view of misrepresentations made to the court, particularly in official filings upon which the court might rely on making a decision. If the court should determine that any misrepresentations were made in the extension request, sanctions may be imposed. ALL COUNSEL ARE SO ADVISED.
